1.1 The Chemainus Theatre Festival (“The Festival”) is the sole “Sponsor” and “Administrator” of the “2020 Season Ticketholder Early-bird, Trip to NYC” Contest (the “Contest”).
1.2 Contest starts at 12:00 a.m. PST on Wednesday, October 23, 2019 and closes at 11:59 p.m. PST on December 13, 2019 (the “Contest Period”).
The Contest will consist of one (1) random draw from all eligible entrants during the Contest Period.
2.1 This Contest is open to any individual who:
purchases a Chemainus Theatre Festival 2020 Season Ticketholder package, or who completes the no purchase necessary entry option, during the Contest Period, and
is a Canadian resident (except those residing within the Province of Quebec) who is the age of majority in their province of residence at the time of entry in the Contest (“Entrants”);
2.3 The Contest is not open to employees or representatives (or those with whom they are domiciled whether related or not) of the “Sponsor” or its agents/affiliates/partners (collectively the “Contest Parties”). By entering this Contest, the entrant represents on behalf of him/herself that the entrant has read, understood and agreed to comply with these Official Contest Rules. Entry into this Contest constitutes your acceptance of these Official Contest Rules (“Rules”).
3. HOW TO ENTER:
3.1 The entrant is automatically entered into a random draw of all entrants by:
purchasing a Chemainus Theatre Festival 2020 Season Ticket package. One (1) entry given for each package purchased during the Contest Period, or by mailing a 140-word original essay on the benefits of theatrical arts in the community along with your name, address, and telephone number to “Season Ticket 2020 Early-bird Contest”, 9737 Chemainus Rd, Chemainus, BC V0R 1K0. Entries must be postmarked no later than December 8, 2019 and received before December 8, 2019. Only one entry per envelope. Entries made without purchase are limited to one (1) per individual.
3.2 By entering, entrants signify that they have read and agree to be legally bound by the terms and conditions of these Rules and that they have all rights to submit their Submission.
3.3 If it is discovered that any one person has attempted to obtain more than the number of entries allowed by these Rules, then (in the sole and absolute
discretion of the Sponsor) he/she may be disqualified from the Contest and all of his/her entries voided.
3.4 The Released Parties (as defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible entries (all of which are void).
3.5 All entries are subject to verification at any time and for any reason whatsoever. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo or video identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification.
4. HOW TO WIN:
4.1 The Prize draw will be held in Chemainus, British Columbia, within approximately ten (10) business days of the end of the Contest Period (the “Draw Date”). Potential Prize winners will be drawn from all eligible entries received during the Contest Period. The odds of winning depend on the number of eligible entries received.
5.1 The Prize for the Contest, valued up to $5,000 CDN will consist of:
Two (2) roundtrip flight from Victoria, BC to JFK airport in New York, four (4) nights accommodation, one pair of tickets to two (2) different Broadway shows, shared roundtrip airport transfers for two (2). Cost will vary based on when the trip is booked.
The total value of the Prize awarded is $5,000 Canadian dollars (referred to collectively herein as, the “Prize”).
5.2 The Prize must be accepted as awarded. No substitutions of the Prizes are permitted except by The Sponsor at its discretion. The Sponsor reserves the right to
substitute any of the Prizes with other Prizes of equal or greater value if any Prize cannot be awarded as described for any reason. Prizes are non-transferable and are not redeemable for cash or credit, in whole or in part.
5.3 The Sponsor will notify each potential winner by email or phone within fifteen (15) business days of the relevant Draw Date. Potential winners will have three (3) business days from notification to accept the Prize by email or phone, and will be instructed about how to claim their Prize at that time. The Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify the potential winner. If a selected Entrant cannot be contacted or fails to respond within the allotted time The Sponsor reserves the right to void that entry and select another potential winner for that Prize. In the event that the subsequent potential winner cannot be contacted or fails to respond, a further entrant will be selected, until a winner is determined, provided further that in the event that a potential winner is not determined after attempts have been made to contact three (3) Entrants, The Sponsor may elect not to conduct any further redraws and not award such Prize.
5.4 In order to be declared an official winner, the selected entrant must correctly answer a time-limited, skill-testing mathematical question without mechanical or other assistance. The potential winner may be required to complete, and return to The Sponsor a Contest Winner Release Form within three (3) days of receipt. If a selected Entrant(s) fails to complete, and return the Contest Winner Release Form to The Sponsor within three (3) business days and/or provides an incorrect answer to the skill-testing mathematical question, The Sponsor reserves the right to void that entry and select another eligible Entrant for that Prize. By completing, and returning the a Contest Winner Release Form, the Entrant: (i) confirms compliance with these Official Contest Rules ; (ii) releases and forever discharges The Sponsor, its affiliates and subsidiaries and its third party contest administrators from all claims, demands, damages, actions and causes of action arising or to arise by reason of the acceptance or use of the Prize; and (iii) gives permission to The Sponsor, at its option, to publish or otherwise use the Entrant’s name, address, photograph, voice and comments, without compensation, in any publicity carried out by The Sponsor or its advertising agencies.
6. GENERAL RULES:
6.1 By participating in this contest, each entrant and winner agrees to: (a) be bound by these Official Contest Rules and the decisions of The Sponsor; and (b) release and hold harmless The Sponsor, and its stakeholders, officers, employees, and agents from and against any and all liabilities, losses, claims, demands, costs and expenses (including lawyer’s fees and litigation expenses on a solicitor and own client basis) whatsoever to which any of them may become subject arising from any actions or omissions by the entrant.
6.2 By participating in this contest, each entrant and winner agrees that The Sponsor may post the winner’s name on any public media channels.
6.3 The decisions of The Sponsor in relation to this contest will be final and binding on all entrants.
6.4 The Sponsor reserves the right to cancel, terminate, or suspend this contest, at its discretion, at any time without prior notice.
6.5 This contest is subject to all applicable laws of the Province of British Columbia and the laws of Canada applicable therein, as well as these Official Contest Rules.
7. APPLICABLE LAWS:
The Contest is subject to all applicable federal, provincial, and municipal laws and regulations.
8. IDENTITY OF THE WINNER:
8.1 Contestants may obtain the names of prize winners by writing to Chemainus Theatre Festival, and by sending a self-addressed, sufficiently stamped envelope, within 30 days of the applicable draw to “Season Ticketholder 2018 Early-bird Contest”, 9737 Chemainus Rd, Chemainus, BC V0R 1K0.
8.2 Personal Information: Contestant personal information will be used solely for the purposes of contacting and identifying Contest winners. Such personal information will be destroyed approximately 30 days from the date of the draw.
